231. (1) Murder is first degree murder or second degree murder.
(2) Murder is first degree murder when it is planned and deliberate.

Murder may fall in one of three categories: First Degree Murder, Second Degree Murder and Manslaughter. All three categories are straight Indictable and can carry a maximum of life in prison.
Noting the above, not everyone that is charged with an offence is found guilty. The Crown Attorney has the burden of proving all the elements of the offence beyond a reasonable doubt.
